1. Introduction & General Terms

These Terms and Conditions govern all products and services supplied by Oakwell Garden Products LTD. By accessing our website, placing an order, or using our services, you agree to be bound by these Terms and by the laws of England and Wales. Any disputes arising from these Terms fall under the exclusive jurisdiction of the English courts.

If any provision is deemed invalid or unenforceable, it will be removed without affecting the validity of the remaining Terms. Failure by Oakwell Garden Products LTD to enforce any provision shall not be considered a waiver of our right to enforce it at a later time. No amendment or variation of these Terms is valid unless agreed in writing and signed by authorised representatives of Oakwell Garden Products LTD.

2. Communication

We provide separate contact details for different types of enquiries. All official contact information, including email addresses and telephone numbers, is listed in the “Contact Us” section of our website. Correspondence may also be provided through company literature. All communications from us will relate only to agreed services or products.

3. Payment Terms

We accept cash, major debit/credit cards (excluding American Express), BACS transfer, and bankers drafts. Payment terms are payment in full within 30 days from the end of the month of purchase. All goods remain the property of Oakwell Garden Products LTD until paid for in full.

Late payments will incur interest at 2% above the Bank of England base rate until full settlement is received. Outstanding balances exceeding 60 days may be referred to debt recovery agencies or the Small Claims Court, and all administrative and legal costs will be payable by the customer.

Returned cheques incur a £25 fee for banking and admin costs. A second returned cheque may result in termination of credit facilities, with all future transactions being cash only.

4. Delivery Terms

• 4.1 Delivery charges vary based on distance, load size, and product type.
• 4.2 Delivery dates or times are estimates and may change due to operational factors.
• 4.3 Someone must be present to accept delivery; failed delivery attempts may incur additional charges.
• 4.4 Customers must ensure safe and accessible delivery conditions.
• 4.5 Surface damage caused by delivery vehicles is not our responsibility unless due to proven negligence.
• 4.6 Goods must be checked upon arrival; errors must be reported immediately.
• 4.7 We may decline delivery to unsafe or unsuitable locations.

5. Concrete Deliveries (Heavy Goods)

• 5.1 All general delivery terms in Section 4 apply to concrete deliveries.
• 5.2 A responsible person must be present to assist with offloading.
• 5.3 Delivery sites must be fully accessible and suitable for heavy vehicles.
• 5.4 A maximum waiting time of 10 minutes is included. Delays beyond this caused by site access or lack of assistance may incur additional charges.
• 5.5 We are not liable for any surface or property damage caused by heavy vehicles unless due to proven negligence.
  
  

6. Stock Availability

We strongly advise customers not to book contractors or schedule work until all materials have been delivered and checked. We cannot compensate for contractor costs if delivery is delayed. From time to time, orders may be delayed due to stock shortages. If this occurs, we will notify you by phone or email.

 

7. Timber Products

Timber is a natural product and may expand, contract, twist, crack, or change colour over time. These changes are not considered faults. We recommend treating timber products regularly and following all care instructions to maintain performance and appearance.

8. Returns & Refunds

Customers may return eligible products within 14 days of receiving the goods. Damaged or missing items must be reported within 48 hours of collection or delivery.

Non-returnable items include:
● Timber cut to size
● Non-standard/made to order fence panels
● Special order gates or bespoke products
● Perishable products, Postmix Unless faulty, these items cannot be refunded.
All returned goods must be unused, clean, in original packaging, and accompanied by the purchase invoice. A 10% handling fee will apply to returns due to customer over-ordering.
Goods must be returned at the customer’s own cost. We recommend obtaining proof of postage, as we cannot accept responsibility for items lost before reaching us.

9. Cancellations

Cancellation of orders must be made in writing. Made to order, cut to size, or bespoke items cannot be cancelled once production has begun. Standard orders may be cancelled prior to dispatch, but restocking or administration fees may apply.

10. Liability

Oakwell Garden Products LTD is not responsible for indirect or consequential losses, including lost earnings, contractor fees, delays, or expenses arising from the use or delivery of our products, except where required by law. Our liability is limited to the value of the goods purchased.

11. Confidentiality & Data Protection

We comply with the Data Protection Act and treat all customer records as confidential. Information may be shared with manufacturers or suppliers only when required to fulfil an order, or with authorities when legally required.
Customers may request copies of their records with reasonable notice. We do not sell, rent, or share personal information with third parties, nor do we send unsolicited emails.

12. Log Files

Our website automatically records standard information such as IP addresses, browser type, access times, requested URLs, and referral paths. This data is used for system administration and analysis and is not linked to personally identifiable information. It is never shared externally unless legally required.

13. Cookies

Our website uses cookies to improve functionality and user experience. Cookies may also be used by affiliate partners. You may disable cookies in your browser settings, though some site features may not function correctly.
